Governor Jerry Brown signed into law a bill that will restrict the use of credit checks during the employment process. Currently, many companies utilize credit reports as one of the tools used in a background check process. As of January 1, 2012, this practice will no longer be allowed, except in particular instances as defined by Assembly Bill (AB) 22.
The exceptions to this new bill include those companies or agencies that are hiring individuals for the following types of employment:

A managerial position;
A position in the state Department of Justice;
A sworn peace officer or other law enforcement position;
A position for which the information contained in the report is required by law to be disclosed or obtained
A position that involves regular access to specified personal information for any purpose other than the routine solicitation and processing of credit card applications in a retail establishment;
A position in which the person is or would be a named signatory on the employers bank or credit card account, or authorized to transfer money or enter into financial contracts on the employers behalf;
A position that involves access to confidential or proprietary information; or
A position that involves regular access to $10,000 or more of cash.

With any of the positions above, the new bill requires that the applicant be notified that a credit check will be performed and have a right to a copy of this report. If a prospective candidate is not hired due to the findings on the report, the applicant must be told that the decision was a result of the findings.
This bill is a result of the criticism that has emerged during the recession about the use of credit information in employment decisions. Due to layoffs and job loss, people have ended up with poor credit, which in many instances has resulted in applicants not being considered further as potential candidates. The underlying concern has been that a credit report is not an indication of job performance, and that using these reports in a hiring decision can discriminate against people with bad credit who would otherwise make good employees.

There have been instances of people being refused employment due to failing a drug testing requirement. After rehabilitation, they have been refused employment a second time by the same company. The Court of Appeals disagrees with the ADA and FEHA, and has stated that due to a prior failed drug test, whether a person suffers from addiction or is a recreational drug user, they can be refused employment. The Court states that the failed drug test is the event that triggered the action of the company, not the applicants addiction. Even if an applicant passes every aspect of the background check but fails a drug test and reapplies, he or she can be refused employment a second time without any recourse against the company doing the hiring.

The trend of late is an epidemic of lying.
Given the recession, weve seen a dramatic increase in the last year  of applicants who have gone off the path with telling the truth, he  said from his Liberty Alliance Inc. office in Orange County, Calif. His  company counts clients throughout the tristate region, notably a lot in  New York City, north to Pine Bush and the Capital District, and  extensively in Fairfield County, Conn.
People say they have a certain degree and they dont, Dyer, 35 and  the company CEO, said with the surety of someone who will find you.  They say they were a manager when they werent. Theyre taking a big  chance with their reputations.
Hell check you out for as little as $10 to $15 or hell put you  through the wringer for $250 andndash; the Platinum Plan. Contracts, he  acknowledges, cross a broad spectrum of applicant numbers and depth of  curiosity. As he spoke, the ink had just dried on a deal to investigate  would-be West Coast EMTs.
It can be funny at times, he says: You would not believe the level  to which people will misrepresent themselves on a resume. For our own  employees who have just started, some of it can be funny for perhaps  the first hundred. The level of dishonesty; they cant believe it.
The danger could not be clearer. The new hire who has lied and who is  now in over his or her head or an under-qualified manager or a big rig  driver with a checkered driving record in another state.
Dyer puts great stock in human contact, chatting up contacts. He  knows, he says, the value of spoken inflection and the value of how  questions are asked. You get people talking. New California Bill Regulates Offshoring of Background Checks
Recently, California Governor Arnold Schwarzenegger signed a bill SB 909 into law. Essentially this bill requires background check companies to inform consumers if their information will be sent overseas. What does this mean for Liberty Alliance customers?

Liberty Alliance NEVER sends information for domestic searches to any company or individual overseas. For International Searches, notice is already given to your applicants. 
Liberty Alliance does not offshore any of its work. 

Because we do not take part in this practice, which is very common in the largest commodity type background check companies, you will not be impacted. No changes to your process, release forms or other areas will be necessary. Additionally, we hope our clients will understand the value of having their searches done by our employees here in the United States. Liberty Alliance believes that having background checks run by firms or individuals overseas is risky and irresponsible.

Number of Older Adults Treated for Substance Abuse Doubles
The number of older adults admitted to substance-abuse treatment facilities has more than doubled since 1992, according to the Substance Abuse and Mental Health Services Administration.The report notes demographic shifts that suggest these patients are less economically stable. Peter Delany, an expert in substance abuse and director of the substance abuse organization's Center for Behavioral Health Statistics and Quality, says many of the shifts reflect overall national demographic changes."What we have is a group of older people who have fewer resources socially, fewer fiscal resources, and have less employability," he says.
